1. Acceptance of Terms
These Terms of Service govern your use of the Pyxelio Agency website and services operated by Pyxelio Digital ("we", "our", or "us").
By using our website or services, you confirm that you have read, understood, and agreed to these Terms and our Privacy Policy.
2. Service Scope
Pyxelio Agency provides a subscription-based design service for businesses and organizations.
- Unlimited design requests
- One active request at a time
- Average turnaround of 24-48 hours for most standard tasks
- Unlimited revisions
- Dedicated designer/video editor support
3. Request Queue and Delivery
Requests are handled through a queue. We work on one active request at a time per subscription.
Each request should represent a single design task that can reasonably be completed within the standard turnaround timeframe. Larger or complex projects may be divided into multiple tasks at the discretion of Pyxelio Agency and processed sequentially within the request queue.
- Additional requests stay in queue order until the active task is completed
- Turnaround may vary based on task complexity, clarity of instructions, and client response time
Pyxelio Agency aims to complete most standard requests within an average turnaround time of 24-48 hours. However, turnaround times are estimates and may vary depending on request complexity, clarity of instructions, revision cycles, and operational workload. Pyxelio Agency does not guarantee specific delivery times, and delays in turnaround shall not constitute a breach of these Terms or grounds for refund.
4. Billing and Payments
Subscription billing is managed by invoice, not automatic card charging.
- Billing cycles may be monthly, quarterly, or yearly
- Service starts after invoice payment is confirmed
- Unpaid invoices may delay, pause, or suspend service access
- Payments for active billing periods are non-refundable except where required by law
5. Fair Use and Resale Restrictions
Subscriptions are provided under a fair use model to ensure consistent service quality.
Pyxelio Agency offers unlimited requests under a reasonable use model. The service is designed to provide ongoing creative support rather than unlimited simultaneous production. If request volume, task complexity, or usage patterns significantly exceed normal operational expectations, Pyxelio Agency reserves the right to review the account and adjust workflow, temporarily limit requests, or suspend the service.
- The service is licensed for one client business or organization per subscription
- A subscription is intended for use by a single business or organization. The service may not be resold, shared across multiple unrelated businesses, or used to provide services to multiple external clients without prior written approval from Pyxelio Agency.
- Excessive, abusive, or bad-faith usage may result in service review, limits, suspension, or termination
6. Communication and Meeting Limits
Communication is primarily handled through agreed async channels such as email or project management tools.
- Clients must provide clear briefs, assets, and feedback for each request
- Real-time meetings or calls are not included unless explicitly stated in writing
- Response delays may impact turnaround and delivery timelines
7. Client Responsibilities
- Provide accurate project information and lawful materials
- Maintain professional and respectful communication
- Ensure provided content does not violate intellectual property rights
8. Intellectual Property
Ownership and usage rights for deliverables are governed by our Copyright Policy. Unless restricted by written agreement or NDA, we may display completed work in our portfolio and promotional materials.
9. Suspension and Termination
We may suspend or terminate services, with or without notice, if:
- These Terms are breached
- Invoices remain unpaid
- The service is used unlawfully or abusively
- Client behavior is harmful, threatening, or repeatedly disruptive
10. Limitation of Liability
To the maximum extent permitted by law, Pyxelio Agency is not liable for indirect or consequential losses. Our total liability for any claim is limited to the amount paid for the specific service period related to that claim.
11. Changes and Governing Law
We may update these Terms from time to time by publishing a revised version with a new "Last Updated" date. These Terms are governed by the laws of the jurisdiction in which Pyxelio Digital operates.
